The point is not that he may have deserted, it is that for whatever reason he was still considered to be an American soldier and being held captive. How many cases of a soldier being court-martialed while being held captive can one find in history? Now that he's back, the decision by the military to prosecute him for being a deserter or not can be made.

finally- we know- he IS a deserter-
can you provide a link to that fact?
the facts are this- he WAS held captive- fact is- we have done similar trades in the past.
was kind of silly, seeing North call this an unprecidented step-
and now he is on FAUX...............go figure
